These Terms of Service ("Terms") govern your access to and use of AccurateBids LLC's software platform ("Service"), operated by AccurateBids LLC ("AccurateBids," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
AccurateBids is a cloud-based quoting, invoicing, job management, and payment software platform designed for home service contractors including HVAC, plumbing, electrical, and related trades. The Service enables contractors to create and send quotes, collect digital signatures, accept online payments, manage jobs, and communicate with customers.
You must be at least 18 years old and operate a legitimate business to use AccurateBids. By creating an account, you represent that all information you provide is accurate and that you have the authority to bind your business to these Terms.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at orville@accuratebids.com if you suspect unauthorized access.
AccurateBids offers subscription plans billed monthly. All plans include a 14-day free trial. After the trial, your selected plan will auto-renew monthly. You may cancel at any time; cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
Prices are listed in USD and may change with 30 days' notice to existing subscribers.
AccurateBids integrates with Stripe Connect to enable contractors to collect deposits and payments from their customers. To accept payments you must connect a Stripe account and you agree to Stripe's Connected Account Agreement and Services Agreement.
You use your own Stripe account, and you are the merchant of record. To accept customer payments you connect your own Stripe account. Payments your customers make settle directly to that account, and you (your business) — not AccurateBids — are the merchant of record for those transactions. You are solely responsible for the underlying goods and services, for delivering them, for any deposits you collect, and for issuing refunds. As merchant of record, you bear responsibility for chargebacks, disputes, and any related fees on payments to you.
AccurateBids takes no cut of your customer payments. AccurateBids does not charge a fee on, or take a share of, payments between you and your customers; standard Stripe processing fees apply between you and Stripe. AccurateBids is a software platform that facilitates payments through Stripe; it is not a bank and is not itself a payment processor, and is not liable for payment disputes, chargebacks, delays, or errors that occur through Stripe.
Optional card surcharge. The Service may let you add a surcharge to credit-card payments to offset your processing cost. If you enable a surcharge, you are solely responsible for complying with applicable law and card-network rules, which generally require that the surcharge apply to credit cards only (not debit or prepaid cards), not exceed your cost of acceptance or the network cap (typically 3%), be clearly disclosed to your customer before payment, and not be charged where prohibited (including in states that ban surcharging). Any surcharge collected is paid to you, not to AccurateBids.
Deposits and balances. The Service lets you request a deposit and collect the remaining balance later. The amount, timing, and refundability of any deposit are terms between you and your customer; AccurateBids does not set or guarantee them.
The Service uses electronic signatures and electronic records for quotes, service and maintenance agreements, and related documents. By using the Service — and, for your customers, by signing or approving a document through a link you send them — each party consents to transact electronically under the U.S. ESIGN Act and the Uniform Electronic Transactions Act (UETA).
You are responsible for the content of your agreements. Any contract, maintenance agreement, scope, or terms you create, edit, or send through the Service — including any starter template AccurateBids provides — are your documents. Templates are samples for convenience only, are not legal advice, and should be reviewed by your own attorney for your state and trade before use. AccurateBids is not a party to and is not responsible for agreements between you and your customers.
You agree not to use AccurateBids to:
You own the data you input into AccurateBids (customers, quotes, invoices, etc.). We process your data only to provide the Service and as described in our Privacy Policy. We do not sell your data to third parties.
AccurateBids and its underlying software, design, and content are owned by AccurateBids LLC. You receive a limited, non-exclusive, non-transferable license to use the Service during your subscription. All rights not expressly granted are reserved.
We strive to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible. We are not liable for losses caused by downtime.
To the maximum extent permitted by law, AccurateBids LLC shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
You agree to indemnify, defend, and hold harmless AccurateBids LLC and its owners, employees, and suppliers from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) the data and content you enter, including your customers' information; (c) your transactions, work, quotes, invoices, or disputes with your customers; (d) your messages sent through the Service; or (e) your violation of these Terms or any applicable law.
The Service is provided "as is" without warranty of any kind. AccurateBids does not warrant that the Service will be error-free, secure, or meet your specific requirements.
AccurateBids offers optional AI-powered features (such as the AI Scope Assistant, AI Photo-to-Quote, supplier-quote / price-list scanning, and the Quick Estimate command bar) that generate suggested scopes, line items, materials, labor, and price estimates. When you use these features, content you submit — including typed commands, text, blueprints, photos, and supplier quotes — is processed by our third-party AI provider as described in our Privacy Policy. You are responsible for obtaining any consent needed before uploading photos or information relating to your customers or their property.
The Quick Estimate command bar interprets a short instruction you type (for example, "estimate for a customer, $3,000, changing a tire") and prepares an estimate. When details are missing or ambiguous, it shows you the interpreted customer, job, and amount for your review and does not create or send anything until you confirm. When your instruction clearly directs it to send and the customer already has an email on file, it may create the estimate and send it automatically after a brief on-screen cancel ("Undo") window, which you can stop at any time before the email goes out. You are solely responsible for the accuracy of the customer, recipient, description, and price on every estimate you create or send, whether entered manually or generated from a command. AccurateBids is not responsible for an estimate created, or an email sent, based on a command you submitted.
All AI output is provided for convenience as a starting draft only. It is not professional advice and is not a guarantee of pricing, scope, equipment compatibility, code compliance, or any outcome. You must independently review, verify, and edit all AI-generated content before relying on it, sending it to a customer, or performing work. To the maximum extent permitted by law, AccurateBids is not liable for errors, omissions, or inaccuracies in AI-generated content or for any decisions made in reliance on it.
You may cancel your account at any time. We may suspend or terminate your account for violation of these Terms. Upon termination, your access ends and we may delete your data after 30 days.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Subject to any informal-resolution requirement, any disputes shall be resolved in the state or federal courts located in Wyoming, and you consent to venue there. Before filing a claim, you agree to contact us at orville@accuratebids.com and attempt to resolve the dispute informally for at least 30 days.
We may update these Terms at any time. We will notify you by email and update the "Last updated" date above. Continued use after changes constitutes acceptance.
If you or your customers provide a mobile number or enable text messaging, AccurateBids may send SMS messages about quotes, invoices, jobs, and account activity.
